Mediation is a process in which Pierse Fitzgibbon acts as an impartial and independent third party to facilitate the communication and negotiation between business parties. The aim is to promotes voluntary decision making by these parties to resolve a dispute and to assist them to reach a mutually acceptable solution.
Mediation is a process whereby an independent and neutral Mediator assists you to come to an agreement. The Mediators at Pierse Fitzgibbon are not attending the mediation to judge and do not give decisions on who is right or wrong. The Mediators are there to support the parties in identifying the issues and needs of those involved. Also, the Mediators may explore how those needs may be addressed and how you may come to an agreement.

There are countless situations where mediation is suitable, but one thing must be clear: all parties involved must agree to employ a mediator. They must sign up to an agreement before the mediation begins whereby they agree that everything discussed during the mediation process will remain strictly confidential and shall not be admissible in court.
Our objective is to bring people together in order to settle a dispute while acting as an unbiased third party. The mediators at Pierse Fitzgibbon will remain neutral and impartial at all stages of the mediation process. The mediator does not provide any legal advice. However, parties may agree to have their legal representatives present at the mediation.
