This area of practice involves using debt recovery and litigation techniques on behalf of Pierse Fitzgibbon clients to get their customers to comply with their legal obligations. Some of the obvious areas that enforcement law is required is paying for train tickets, Luas tickets, paying taxes or tolls.
Pierse Fitzgibbon clients are looking for maximum compliance. When engaging with these clients we firstly determine their business needs. These needs include the recovery of outstanding monies due to the client, the sensitivity of the client’s brand and their business development requirements. We then work out a plan of how to best achieve their business needs.
This plan will usually involve issuing Liquidated Sum Civil Summonses or in some cases criminal summonses. In order to enforce the Judgments obtained we will usually engage with the sheriff for seizure of goods or register the Judgment so that it can affect the defaulter’s credit rating. Other options that are available include Judgment Mortgages, Instalment Orders and engaging with the Insolvency Service of Ireland.
Enforcement Law involves exerting an appropriate amount of psychological pressure on defaulters to essentially teach them that it is better to comply with their legal obligations than default. We will recommend to our clients to give media exposure to the enforcement achievements. Essentially this will help our clients to keep their compliant customers compliant and to encourage those who are not, to become compliant with their legal obligations.
